Terms of service

Last updated

These terms cover the consulting sold by Olivencia Inc., incorporated in California (“we”, “us”). The consulting is delivered by Gabriel Olivencia. By accepting a proposal and paying for an engagement, you agree to these terms.

What we sell

One-to-one business consulting: advice and working sessions on earning your customers’ trust, including your profile and digital presence, word of mouth, communication, branding, sales, marketing and customer service.

How an engagement is agreed

Every engagement is scoped and quoted individually. After we have talked, we send you a written proposal that sets out what we will do, the sessions or other work included, the timeline and the price. Nothing is agreed or billed until you accept the proposal.

Payment

Once you accept a proposal, we send you a Stripe payment link for the amount in it. Payments are processed by Stripe, and we never see or store your full card details. Unless the proposal says otherwise, payment is due before the first session. The price in your accepted proposal does not change during the engagement.

Sessions

Sessions take place at times and in a format we agree in advance. Cancelling, rescheduling and refunds are covered by our refund policy.

What consulting is, and what it isn’t

Consulting is advice. You get our honest, best judgement, but results depend on many things we don’t control, including how the advice is applied. We don’t guarantee any particular revenue, growth or outcome.

We are not your lawyer, accountant or financial adviser, and nothing we provide is legal, tax or financial advice. Decisions about your business remain yours.

Confidentiality

We keep what you tell us about your business confidential. We use it only to deliver your engagement, unless you agree otherwise or the law requires us to disclose it.

Materials

Notes, plans and other materials we create for you during an engagement are yours to use in your business. We keep the right to use our general know-how and methods with other clients.

Liability

To the extent the law allows, our total liability for any claim connected to an engagement is limited to the amount you paid for that engagement. We are not liable for indirect or consequential losses, such as lost profits.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be heard in the state or federal courts located in California.

Changes to these terms

We may update these terms. The version that applies to your engagement is the one published when you accepted your proposal.
